1Acceptance of Terms & Operating Entity

By accessing or using the LinguoPath platform, website, or mobile-responsive applications, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2Age Eligibility, Minors & Parental Consent (COPPA & GDPR)

LinguoPath is designed and intended strictly for individuals who are at least thirteen (13) years of age. In compliance with the U.S. Children's Online Privacy Protection Act ("COPPA"), Regulation (EU) 2016/679 ("GDPR" Article 8), and international child online safety standards, children under the age of 13 are strictly prohibited from registering or using our platform.

Teenage Learners (Ages 13–17): We recognize that many candidates preparing for Cambridge B1 Preliminary, B2 First, and C1 Advanced examinations are teenagers. If you are between 13 and 17 years old, you may only register and use LinguoPath with the knowledge and affirmative consent of a parent or legal guardian. By creating an account or using microphone features for speech practice, you certify that your parent or guardian has reviewed and agreed to these Terms and our Privacy Policy.

3Description of Service & Third-Party Trademark Disclaimers

LinguoPath is a self-serve educational SaaS platform providing interactive English language practice, diagnostics, and AI-evaluated simulations intended to assist candidates preparing for international English examinations.

4Voice Recording & Speech AI Terms

By engaging with our speaking practice or mock examination voice recorders, you grant LinguoPath a limited, non-exclusive license to process your spoken audio ephemerally in-memory through our AI evaluation service solely to generate text transcripts, fluency statistics, and scoring feedback. Raw audio files are not stored permanently on our servers and are never used to train public foundational AI models.

5Subscriptions, Merchant of Record & Refunds

Certain features (including unlimited practice sets, full mock exams, AI writing rubric evaluations, and speaking examiner simulations) require an active Premium subscription. All order processes, subscription billing, and tax collections are conducted by our authorized reseller and Merchant of Record, Lemon Squeezy (a Stripe company).

Instant Digital Delivery: All paid features, mock exam access, and AI evaluation services are digital SaaS products provisioned immediately upon successful completion of checkout or free trial activation.

Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. Monthly subscriptions include a 7-Day Free Trial, and all purchases (including 3-Month and 6-Month fixed passes) are backed by our 14-Day Money-Back Guarantee. 6Acceptable Use

You agree not to use the service to:

• Submit abusive, defamatory, sexually explicit, or illegal content in writing or speaking exercises.
• Attempt to manipulate, reverse-engineer, exploit, or bypass the AI evaluation systems or rate limits.
• Scrape, duplicate, distribute, or publicly re-post the proprietary practice prompts and mock papers without prior written authorization.

7Limitation of Liability

In no event shall LinguoPath or its operator, Cristian Leonardo Mier Jimenez, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, exam test fees, or other intangible losses resulting from your access to, use of, or inability to access or use the Service.

8Governing Law & Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of Ecuador, without giving effect to any principles of conflicts of law. Any legal dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Quito, Pichincha, Ecuador.
